The arrival of the new year also brings a tightening of some sanctions, and the entry into force, from the month of March, of the new regulations contained in the Traffic Law. Although there are still a few months to spare, it is convenient to know the main changes.

, the objective of this normative modification has been to update several precepts of the Law on Points Permit, a tool that has been shown to be valid for reducing road accidents, but it was necessary to update to improve the efficiency of the system, adapt it to the times and strengthen road safety.

The main novelties regulate issues as diverse as driving distractions, use of the seat belt and safety elements, courses for the recovery of license points, circulation of bicycles and motorcycles, speed limits and overtaking, and even regulates the penalties for accessing the low-emission zones that are gradually to be implemented in cities with more than 50,000 inhabitants.

The use of detectors or inhibitors in the vehicle is also illegal and the new Traffic Law approved last November by the Council of Ministers, further toughens this type of crime. The penalties for the use of the detectors vary depending on the device in question that the vehicle is equipped with:

Inhibitor: Track the radars and disable their operation. Using a radar jammer when driving is punishable by a fine of up to 6,000 euros and 6 points. In addition, the workshop that installs the device can also be penalized, with up to 30,000 euros.

Detector: This device tracks and locates nearby radars. Its use is prohibited and is considered a serious offense and it is sanctioned with a 500 euros fine and the withdrawal of 3 points from the permit.

Timer: GPS (and mobile phone apps) include a database with the location of fixed radars and road sections, place them on the map and alert the driver of its proximity. Its use is legal.

Since 2016, distractions at the wheel are the leading cause of fatal accidents (31%), in 2020 increased 3 points over the previous year. Belt and safety elements

Cyclists’ safety is increased by making it mandatory, on roads with more than one lane in each direction, change lanes when overtaking cyclists or mopeds. In addition, the points to be detracted are increased from 4 to 6 when overtaking endangering or hindering cyclists without leaving the mandatory minimum separation of 1.5m, maintaining the amount of 200 euros. Stopping or parking on bike lanes or cycle paths is also prohibited.

Objects on the road and recovery of points

Increase from 4 to 6 the points to be deducted for throwing objects on the road or in its vicinity that can cause accidents or fires.

The new Law also unifies the period to recover the card points, establishing a period of 2 years without committing infractions so that a driver can recover his initial balance of points.

Until the approval of the reform of the Law, this period varied depending on the severity of the offense committed. It has been simplified, so that it is easier to understand and communicate.

2 points of the license can be recovered for taking courses on safe and efficient driving. A Ministerial order will develop the necessary requirements and the conditions that must be met. These courses are becoming established as good practice and represent additional training for drivers.

Alcohol and drugs

Underage drivers of any vehicle (mopeds, AM permit, motorcycles up to 125cc, bicycles and personal mobility vehicles) They will not be able to circulate with an alcohol level higher than 0, both in blood and in expired air.

Mandatory for road passenger transport vehicles that register as of July 6, 2022. These vehicles are required to have an interface installed for the installation of these devices. This is a measure demanded by the road passenger transport sector.

Overtaking and speed limits

The possibility that cars and motorcycles could exceed the speed limits by 20 km / h on conventional roads when they overtake other vehicles is eliminated. This measure is justified by the DGT because 2 out of 3 fatal accidents occur on conventional roads. In 2019, the reference year, there were 239 deaths in a frontal collision on a conventional road. This abolition is in line with the principle of a safe system, of eliminating or reducing risks and overtaking on conventional roads is one of them.


The use of certified wireless devices or approved for use in the protective helmet of motorcycle and moped drivers, for communication or navigation purposes, as long as it does not affect driving safety.

Low emission zones

A new serious offense is introduced, with 200 euros of amount for not respecting the circulation restrictions derived from the application of the protocols in the event of pollution episodes and in the areas of low emissions.

The Climate Change and Energy Transition Law obliges the municipalities with more than 50,000 inhabitants to establish Low Emission Zones.

Cheat on exams

It is entered, as an offense with a 500 euro penalty, to use unauthorized intercom devices regulations in the tests for obtaining and recovering driving permits or licenses or other administrative authorizations to drive or collaborate or assist with the use of said devices. In addition, the applicant will not be able to present himself again to the tests to obtain the permit within a period of 6 months.
